Overview

Division Fence By-law 2023-076 Procedural Guide, a five-page guide from the Town of Oakville to the by-law on sharing the cost of a fence on a property line. It defines a division fence, notes that the Town does not become involved in neighbour disputes, and lays out three steps: reaching agreement with a neighbour, a notice of intent with quotes and a notice of cost recovery, and recovering costs through court. Two sample letters follow. It is a companion to the Fence By-law and Guide to Fence.

What it covers

  • Step 1: Attempt to reach an agreement with your neighbour
  • Step 2: An agreement cannot be reached with your neighbour
  • Step 3: Recovering costs through court
  • SAMPLE LETTER #1 – NOTICE OF INTENT
  • SAMPLE LETTER #2 – NOTICE OF COMPLIANCE
Check this against the municipality before you rely on it.
