Overview

The City of Markham's Tree Preservation By-law, By-law 2023-164, passed December 13, 2023 under the Municipal Act, 2001 and repealing By-law 2008-96. It applies to trees of 20 centimetres DBH or more on private property and to any tree on public lands, and exempts woodlands, woodlots and nurseries. It defines terms such as Qualified Tree Expert and Tree Preservation Zone, then sets out general prohibitions, permit applications, permit conditions and replacement trees, orders, work performed by the City, appeals to a Hearing Officer, fines and administrative penalties.
