By-law No. 08-108 of the City of Hamilton, cited in its own text as the Hamilton Division Fences By-law, respecting the apportioning of costs of division fences within the urban boundary. It defines actual cost and reserve, sets a notice procedure between adjoining owners, and splits the cost of constructing, replacing, maintaining or repairing a division fence, with recovery through legal proceeding. Its recitals note that the Line Fences Act, except section 20, does not apply to land covered by such a by-law. It repeals former City of Hamilton By-law No. 79-175.
